The ninth circuit court has maintained a prohibition on deploying national guard in Portland, Oregon, following a recent court ruling.

Judicial Panel Agrees to Reconsider Legal Matter

The ninth circuit court of appeals decided on Tuesday that it would reexamine the case concerning the president’s authority with an expanded group of 11 judges. The court also vacated a earlier decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This legal directive represents the most recent development in a long-running legal battle over whether the administration has the legal right and justification to deploy state military units in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was started in due to months of protests.

Conflicting Arguments

The administration has argued that government employees at the ICE facility in south Portland were facing threats, while city and state officials maintain that local officers have command of the circumstances.

Contrary to characterizations of Portland as a conflict zone, locals have been sharing footage of lush hiking trails and a thriving food scene, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in Portland enacted two temporary restraining orders this month – one blocking the federal control of the state troops, and another stopping the use of any national guard troops in Oregon, after efforts to circumvent the first order by calling up troops from California.

On Monday, the appeals court had put the first ruling on hold – permitting command of 200 Oregon national guard – but the subsequent injunction stayed effective, blocking the actual deployment of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard “en banc” – with both rulings under review simultaneously – by a group of eleven justices.

“This ruling demonstrates that the truth matters and that the judicial system are working to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” said the legal representative in a statement.

“The court is sending a clear message: the president cannot send the armed forces into American urban areas without cause. We will continue protecting state legislation, principles, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
